TERMS AND CONDITIONS
HR Recruitment Division and Training & Development Division
Effective from 10-November-2022 | Registration and Service Engagement
These Terms and Conditions (the “Terms”) govern every registration, profile submission, recruitment-support engagement, training enrolment, website acceptance and related service provided by DANISHER CONSULTANCY SERVICES (“DANISHER”, “we”, “us” or “our”). By clicking “I Agree”, submitting a profile, making payment, attending an assessment or commencing a programme, the candidate, learner or participant (“you”) confirms that these Terms have been read, understood and voluntarily accepted.
1. Eligibility, Accurate Information and Consent
You must be legally competent to contract. All resumes, certificates, experience details, salary particulars, identity records and declarations must be complete, current and genuine. DANISHER may verify information, request supporting records, correct obvious administrative errors, and suspend or close an engagement where information is false, misleading, materially incomplete or cannot reasonably be verified. You authorise DANISHER to process and share relevant profile information with prospective employers, trainers, assessors and service partners solely for the stated service purpose, subject to applicable law.
2. Professional Conduct and Organisational Rules
You shall observe DANISHER’s lawful policies, interview protocols, training rules, workplace etiquette, confidentiality requirements and reasonable instructions. Harassment, threats, abusive or discriminatory language, impersonation, disruption, unauthorised recording, plagiarism, cheating, document fabrication or other misconduct is prohibited. Respectful communication is the order of the day. After fair notice and an opportunity to clarify, DANISHER may restrict access, discontinue a service or report unlawful conduct where proportionate and legally permissible.
3. Official Communications and Response Duties
Email sent to the address registered by you is the primary official channel, supplemented where appropriate by telephone, messaging applications or the website portal. You must monitor inbox and spam folders and respond within the deadline stated in the communication; where none is stated, within two business days. You must promptly report any change of contact details. Failure to respond after a reasonable reminder may cause an opportunity to lapse or the profile to be placed on inactive status. Reactivation is subject to the continued availability of the requirement; it does not revive an opportunity already closed by a client.
4. Interview Readiness and Candidate Cooperation
You are responsible for preparing for interviews, assessments, document verification and onboarding; attending at the appointed time; maintaining suitable equipment and connectivity for online rounds; and promptly disclosing genuine conflicts or accessibility needs. Rescheduling depends on client or trainer approval and cannot be assured. Repeated absence, unexplained withdrawal or refusal to provide required documents may lead to closure of the relevant process after notice.
5. Nature of Recruitment Support
Recruitment support may include profile review, screening, preliminary or communication rounds, interview preparation, reasonable training or orientation, profile presentation, interview coordination, follow-up and offer/onboarding assistance. The precise scope is the written service confirmation, invoice or engagement note. DANISHER is an independent service provider and, unless expressly stated in writing, is not the employer or the client’s agent for making a final hiring promise.
PART II – HR RECRUITMENT TERMS
Clear expectations, documented service and client-led outcomes
6. Client Control, Timelines and No Guarantee
Shortlisting, interview stages, compensation, location, designation, background checks, offer issuance, joining and withdrawal are controlled by the prospective employer and may change with business requirements. Processing time therefore varies. A submitted profile may be held, delayed, redirected or closed based on client requisition, eligibility, competition, availability and candidate cooperation. DANISHER will use reasonable professional efforts and communicate material updates available to it, but does not guarantee selection, an offer, a joining date, salary, location, visa or continued employment. No oral assurance overrides a written confirmation.
7. Client-Billed and Candidate-Billed Engagements
Where recruitment is client-billed, DANISHER will not charge the candidate a recruitment fee for that vacancy, although separately requested training or ancillary services may carry a clearly disclosed charge. Where you expressly request a candidate-billed recruitment-support service, the fee, scope, milestones, taxes and payment schedule must be disclosed and accepted before payment. Indicative fees are 8.33% to 15% of annual gross salary for fresher or entry-level profiles and 15% to 25% for senior or specialised profiles; the exact rate may vary with role complexity and service scope and will be stated in the written quotation or invoice.
8. What Candidate Payments Cover
Unless a written agreement expressly states otherwise, candidate payments are consideration for the agreed professional and administrative services – including mobilisation, profile screening, preliminary assessment, preparation, training/orientation where included, profile marketing or presentation, coordination and follow-up – and not the purchase of a job or a guaranteed placement. Service delivery begins when DANISHER commences the accepted scope, which may occur upon registration, screening, assessment, training allocation or profile submission. The fact that a client declines, pauses or does not issue an offer does not by itself mean that services already rendered were not supplied.
9. Invoices, Taxes and Payment Records
Fees are payable only against DANISHER’s authorised quotation, invoice, payment link or written instruction. Applicable taxes, including GST where chargeable, shall be shown or dealt with in accordance with law. You must retain receipts and immediately report any suspected unauthorised payment demand. Payments to personal or unapproved accounts are made at your risk unless expressly confirmed by DANISHER in writing.
10. Cancellation, Refund and Service Accounting
Cancellation and refund requests must be submitted in writing and will be evaluated under DANISHER’s refund policy supplied or published at the time of engagement, the accepted service scope, services already commenced or completed, third-party costs, taxes and applicable law. Any lawful refund will be supported by a transparent service and deduction statement where relevant. Nothing in these Terms excludes a mandatory statutory remedy or permits retention of sums that the law requires to be returned. A refund is an organisational decision under policy and law, not an informal commitment by an individual employee.
11. Offers, Joining and Post-Placement Matters
You must independently review any offer, compensation structure, bond, probation, relocation, notice period and workplace policy before acceptance. Employer-issued documents prevail for employment terms. You shall not misrepresent acceptance, hold multiple offers dishonestly or conceal a joining decision. Any post-joining grievance concerning employment should first be raised with the employer; DANISHER may facilitate communication but cannot control the employer’s decision.
12. Third-Party and Overseas Requirements
|
External portals, background-verification agencies, institutions, immigration authorities and employers may impose separate terms and charges. Overseas employment, immigration or education support is subject to a separate written scope and all applicable statutory and regulatory requirements. No visa, permit or overseas placement is promised by these Terms.
PART III – TRAINING, GENERAL AND LEGAL TERMS
A fair framework for participation, payment and resolution
13. Training Enrolment and Delivery
Training details – programme title, syllabus, mode, duration, trainer, schedule, fee, taxes and any stated outcome – will be communicated before enrolment. Reasonable changes to faculty, sequence, platform or schedule may be made for academic, operational or force-majeure reasons, with suitable notice and a substantially equivalent learning opportunity where practicable. Attendance, punctuality, assignments, assessments and professional classroom or online decorum are mandatory.
14. Training Fees, Withdrawal and Refunds
Before training commences, a written withdrawal request will be handled under the disclosed cancellation and refund policy. Once live instruction, recorded-content access, learning-material access, assessment, licence activation or another substantial training benefit has commenced, the fee may become wholly or partly non-refundable to the extent reasonably attributable to services supplied, reserved capacity and non-recoverable costs. DANISHER’s Training Division may approve transfer, deferment, credit or refund in accordance with the published policy and applicable law. This clause does not override mandatory consumer rights or remedies for a proven deficiency in service.
15. Learning Outcomes and Placement Support
Training is intended to develop knowledge and employability; results depend on attendance, effort, aptitude and assessment performance. Certificates may be withheld until academic and payment requirements are completed. “Placement support”, “interview support” or similar language means assistance and facilitation, not guaranteed employment, salary or selection, unless a separate lawful written guarantee expressly states its conditions.
16. Intellectual Property and Confidentiality
Courseware, recordings, templates, tests, databases, methods, branding and portal content remain the property of DANISHER or its licensors. They are licensed for your personal, non-transferable learning or participation only. Copying, resale, public upload, credential-sharing, unauthorised recording or commercial exploitation is prohibited. You must also protect confidential client, candidate and learner information received during the engagement.
17. Privacy and Electronic Acceptance
DANISHER will collect and use personal information reasonably required for registration, screening, recruitment, training, payment, compliance and communication. Relevant information may be shared with prospective employers and authorised service providers for those purposes. Electronic records, email acceptance, website clicks, OTP confirmation and payment conduct may evidence consent to the extent recognised by applicable law. Separate privacy notices or consents will prevail where they provide additional protection.
18. Complaints and Dispute Resolution
Raise any concern with supporting records at hr@danishercs.in. DANISHER will acknowledge and seek to resolve it through good-faith internal review. The parties should first attempt an amicable resolution – putting heads together before taking formal steps – without preventing either party from approaching a competent statutory authority, consumer commission or court where legally entitled. Subject to mandatory law, courts having territorial jurisdiction over Vaniyambadi, Tamil Nadu shall have jurisdiction.
19. Liability, Force Majeure and Statutory Rights
To the fullest extent permitted by law, DANISHER is not liable for indirect or consequential loss arising from client decisions, candidate default, third-party systems or events beyond reasonable control. Nothing excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or a legally established deficiency in service. Performance may be suspended during events beyond reasonable control, with prompt notice and reasonable mitigation.
20. Changes, Severability and Entire Understanding
DANISHER may update these Terms prospectively; material changes affecting an active paid engagement will be notified and will not remove accrued rights. An invalid provision will be narrowed or severed while the remainder continues. These Terms, the accepted service scope, fee disclosure, privacy notice and refund policy form the entire understanding; a specific written term prevails over a conflicting general term.

Terms and Conditions for Refund
These terms explain the conditions for submitting and processing an electronic refund request. Every request is assessed against the service stage, supporting electronic records, the agreed service terms, and applicable Indian law. Submission of a request does not by itself guarantee approval.
- Electronic refund request. The candidate must submit the request electronically within 30 calendar days from the date of cancellation, stating the reason and attaching proof of payment, registration details, approval correspondence (if any), and bank-account details in the candidate’s name.
- Scrutiny and approval. DANISHER will verify the cancellation reason, documents, service stage, client activity, and other relevant records. Approval or rejection will be communicated in writing with the applicable reason.
- Deductions and payment. An approved refund will be processed after deducting the non-refundable basic consultancy charge of Rs. 5,000 for services already rendered and applicable GST/tax adjustments as permitted by law. The approved balance will be credited to the candidate’s bank account within 20 working days after complete documentation and approval.
- Conduct and communication. Abusive, threatening, fraudulent, or seriously unprofessional conduct may lead to suspension of service and lawful action. Where such conduct causes termination of the engagement or demonstrable loss, the refund may be rejected or adjusted, subject to applicable law and written reasons.
- Documents required. Original or verifiable copies of fee receipts, refund approval communication, identity proof, and matching bank details must be produced before disbursement. Missing or inconsistent records may pause processing until clarified.
- Offer issued. Once an employer/client issues an offer or appointment letter through DANISHER’s efforts, the recruitment service is treated as completed and the related fee is non-refundable, except where mandatory law requires otherwise or the employer withdraws the offer for reasons not attributable to the candidate.
- Failure to join. The candidate must join on the date stated in the offer or obtain written approval for a revised date. Refusal, delay, absence, or failure to join for reasons attributable to the candidate will not create a refund entitlement.
- Workplace misconduct. No refund is payable where employment is terminated following a documented finding of workplace misconduct, including intoxication, possession/use of prohibited drugs, sexual harassment or abuse, violence, or other serious breach of employer policy or law.
- Selection and joining support. Refund eligibility ordinarily ends when the client confirms selection. Any optional post-selection or joining assistance beyond the agreed scope will be charged only after the candidate accepts the scope and fee in writing.
- Instalment payments. Payment by instalments does not create a separate refund right. Instalments allocated to training delivered, recruitment work completed, or other services already performed are non-refundable; any eligible balance will be assessed under this policy.
- Final determination. Requests made after the 30-day period may be declined unless delay was caused by circumstances recognised under applicable law. DANISHER’s decision will be based on records and communicated in writing, without limiting any statutory rights or remedies available to the candidate.
By selecting “I Agree”, I confirm that I have read, understood and voluntarily accepted these Terms and the applicable service scope, fee disclosure, privacy notice and refund policy.
